Frequently Asked Questions

  • Does my business qualify for ERC?

To qualify for the Employee Retention Credit (ERC), the employer must have been subject to a COVID-19-related governmental order that suspended business operations or experienced a significant reduction in gross receipts.

Here’s what you need to know:

    • The ERC applies to wages paid between March 13, 2020 and December 31, 2021.
    • Employers with an average of more than 500 full-time employees in 2021 may claim the credit only for wages paid to employees who are not providing services due to the suspension of operations or reduced gross receipts.
    • Small employers with an average of 500 or fewer full-time employees in 2021 are eligible for the credit without regard to whether the employee is providing services.
  • How much can my business claim per employee?

Qualifying businesses can claim up to $7,000 per employee, per quarter for tax year 2021 (up to $21,000 per qualifying employee per year). The $5,000 credit per qualifying employee for tax year 2020 expired on April 15, 2024.

  • When’s the deadline to apply for ERC?

Your business can apply for any unclaimed Employee Retention Credits for tax year 2021 until April 15, 2025. The deadline to make claims for tax year 2020 lapsed on April 15, 2024.
